BPC Solutions LLC, also known in commerce as “Brian Comstock” and “Brian Comstock Coaching” (“we,” “our,” or “us”), values your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard personal data from clients and website users, including sensitive information related to mental health, emotional well-being, and trauma history. This Policy applies to all clients, including those in the United States, European Union, and other jurisdictions.

By purchasing coaching services from BPC Solutions LLC, you agree to the following terms and conditions. These terms are designed to protect both parties, ensure clarity, and mitigate liability. Please read carefully.

Client Disclosure & Agreement

Acknowledgment and Agreement

Before commencing services, you acknowledge that:

You have read and understood this agreement in full.
Your payment confirms your agreement to these terms.
Coaching sessions are designed to assist with personal development and are not a substitute for licensed medical, psychological, or trauma-informed therapy.
BPC Solutions LLC employs Brian Comstock as a coach, along with other coaches, none of whom are licensed therapists.

Scope of Services / Disclaimer

Nature of Services
- Services are considered alternative or complementary health care in many states.
- The practitioner is trained in a variety of coaching modalities, which may include Mental and Emotional Release® (MER®), Neuro-Linguistic Programming (NLP), and Hypnosis, but is not a licensed medical professional.
- These services are not intended to diagnose, treat, or cure any condition and do not replace medical, psychological, or trauma-informed care.
- Clients with a history of abuse, trauma, or other significant psychological concerns are strongly encouraged to consult with licensed mental health professionals for diagnosis, treatment, or crisis support.
Client Responsibility
- You accept full responsibility for consulting a licensed healthcare provider regarding any medical or mental health concerns.
- You are responsible for the outcomes of your own decisions, actions, or inactions.
- Technology Disclaimer: Any technology used for sessions—such as video platforms, apps, or AI tools—is provided “as is.” BPC Solutions LLC disclaims all liability for technical failures, data loss, or security breaches.

Confidentiality

All information shared during sessions is confidential, except as required by law.
Mandatory Reporting: Practitioners will maintain confidentiality except in circumstances where disclosure is required by law, including but not limited to child abuse, elder abuse, or imminent harm to self or others.
Information will be used solely to facilitate the coaching process.

Limitation of Liability & Legal Waiver

By agreeing to these terms, you:

Waive any right to bring claims for dissatisfaction, outcomes, emotional harm, or perceived harm resulting from coaching services, except in cases of gross negligence or willful misconduct.
Acknowledge that results are not guaranteed and depend solely on your participation and application of the coaching strategies provided.
Release BPC Solutions LLC and its practitioners from liability for any emotional, psychological, or financial impact resulting from participation in coaching.
Agree that the practitioner’s total liability is limited to the amount you paid for the coaching session(s).

Emergency Disclaimer

If you are experiencing a mental health emergency or suicidal thoughts, contact your local suicide prevention hotline or emergency services immediately. Coaching services are not a substitute for crisis intervention or emergency care.

Payments, Refunds, and Dispute Resolution

Payment Terms

Subscription payments are recurring and will be automatically charged on the schedule disclosed at checkout.
It is the client’s responsibility to review billing confirmations and receipts. Failure to recognize, remember, or notice a charge does not constitute unauthorized use.
Payments are non-refundable except where otherwise determined by BPC Solutions LLC in its sole discretion, or as required by law.

Refunds

Refunds, if any, are issued at the sole discretion of BPC Solutions LLC, unless otherwise required by law.
Requests to pause, cancel, or modify services must be made in writing prior to the next billing date. Charges that have already been processed remain subject to the terms of this agreement.

Dispute Resolution

In the event of any billing concern, dispute, or dissatisfaction, you agree to first contact BPC Solutions LLC and provide a reasonable opportunity to resolve the issue through good faith communication.
You agree not to initiate a chargeback or payment dispute without first attempting to resolve the matter directly with BPC Solutions LLC. Initiating a chargeback without prior written communication will be considered a material breach of this agreement.
In the event a chargeback is initiated in violation of this provision, BPC Solutions LLC reserves the right to immediately suspend or terminate services and deny any refund requests related to the disputed charge, to the fullest extent permitted by law.
Any dispute that cannot be resolved through direct communication shall be resolved exclusively through binding arbitration under the laws of the State of Texas.

Cancellation & Rescheduling Policy

To cancel or reschedule, you must provide at least 24 hours’ notice to avoid cancellation fees.

Cancellations made with less than 24 hours’ notice or failure to attend will result in the full session fee being charged or deducted from prepaid packages.

Testimonial and Media Use

By providing a testimonial, video, audio, or other media content to Brian Comstock, Brian Comstock Coaching, or BPC Solutions LLC (collectively, “Company”), you grant the Company the right to use, reproduce, publish, distribute, and display your testimonial, including your name, image, likeness, voice, and submitted content, for marketing, promotional, educational, and advertising purposes in any media now known or later developed, including but not limited to social media, websites, email campaigns, and print materials.

You acknowledge that:

Your testimonial may be edited for clarity or brevity but will not be misrepresented.
You will not receive compensation for its use.
You may request that the Company remove your testimonial, and the Company will honor that request.

By submitting a testimonial or media content, you confirm that you understand and agree to these terms.
